I noticed today on the AMSA web site that the new FMSCA rules have been posted along with a link to the FMCSA's web site.   Any thoughts on some of these changes other then another thing to teach ourselves what to do.   I guess the Rogues and Scam movers are also going to follow this info!  RIGHT.

FMCSA.S UPDATED .RIGHTS AND RESPONSIBILITIES. BOOKLET IS NOW AVAILABLE

On April 7, 2006, FMCSA issued a final decision in the Federal Register (Vol. 71, No. 67, p. 17945) that

makes the .Your Rights and Responsibilities When You Move. booklet immediately available on FMCSA.s

website ( www.protectyourmove.gov/consumer/awareness/rights/Rights1.ht m).

In summary, the new booklet contains the following changes:

A set of new definitions.

Authority to collect charges at delivery for:

--100% of a binding estimate

--110% of a non-binding estimate

--Additional services requested by the customer not included in the original estimate

--Impracticable Operations as described in the tariff (Shuttle) not to exceed 15% of all other

charges due at delivery

A requirement to wait 30 days after delivery to bill for charges in excess of 110%.

Authority to bill immediately for shuttle charges in excess of 15% of the charges due at

delivery.

All estimates must be in writing.

All estimates to be based on physical (in-house) survey, if household goods are located within

a 50-mile radius of the location of the agent preparing the estimate. A shipper can waive in

writing a physical survey.

All non-binding estimates must indicate actual charges will be based on actual weight (no

cube, linear foot, etc.).

Mover must provide .Ready To Move. brochure to each customer.

Mover.s liability is Full Replacement Value unless waived in writing by the customer.

Mandatory arbitration threshold is now $10,000 and certain transportation charges can be

subject to arbitration.

There are significant civil and criminal penalties for holding a shipment hostage if customer has paid

for the move in accordance with federal payment requirements.

Yes indeed. I believe the point being that only the good guys are going to follow the old rules or the new rules...so what's the point. If they don't follow the rules they need to be visited by The Moving Police. Opps. There are no more Moving Police. Last time I checked the investigative arm of the STB had something like 3 investigators to cover the entire United States. Hey...there's an idea...hire some more investtigators instead of passing more regulations. Uh oh...that's no good...that would mean the Feds would actually have to do something to fix the problem.
